Reasons for Deportation

Immigration laws in the United States are stricter than ever, and many people are living in fear of deportation. With that said, it is important to be aware of the reasons that you can be deported in the event that U.S. Immigration and Customs Enforcement detains you for being in the United States unlawfully. Some of the primary reasons that you or a loved one could be removed from the United States include the following:

  • Violation of Immigration Law, such as unlawful entry, overstaying your visa, marriage fraud, fraudulent immigration documents, fraudulent evidence of admissibility, and fraudulent declaration of citizenship
  • Criminal Acts, including murder/homicide, rape, assault, fraud, robbery, theft/larceny, and certain drug crimes

Cancellation of Removal

If you have a loved one that has been detained and is facing deportation from the United States, you must speak with an experienced attorney about whether they are eligible for any relief from removal from the U.S.  Many individuals are eligible to file for Cancellation of Removal for Non-Legal permanent residents if it can be shown that the foreign national has been residing in the U.S. for 10 years, not been convicted of certain crimes, have good moral character, and if s/he is deported, their Legal Permanent Resident or U.S. citizen spouse, children, or parents would suffer exceptional and extremely unusual hardship.  This is a very high standard and difficult to prevail in the immigration courts.  Most cases in New York will take several years and upon filing the appropriate forms we can obtain employment authorization for the individual which will allow the individual to work legally in the U.S. and obtain a valid driver license.

Moreover, for permanent residents who are in removal proceedings, generally for convictions of serious crimes, these individuals are also eligible to apply from relief from removal if it can be shown that s/he has lived in the U.S. for 7 years, but the 7 years stops after committing certain crimes, has been a permanent resident for 5 years and there is no time-stop, and whether s/he deserves a second chance.

There are other relief from removal which can be filed as well.  It may be possible to file another adjustment of status application, a waiver, an asylum application, etc.

Eligibility for Bail

A major issue is whether or not someone is eligible for bail in immigration court.  It is imperative that if the foreign national has not been released that you contact Nassau County Immigration Law Group to discuss this issue.  Not everyone will be eligible for an immigration bail and some permanent residents may also not be eligible for release.  To apply for an immigration bond is a complicated process and must be thoughtfully approached.  Nassau County Immigration Law Group has been very successful in obtaining bond for the majority of our clients.
