Conditional Residence

Conditional Residence Attorneys in New York

Some of the ways that people enter the United States for immigration purposes are accompanied by specific conditions on their residence. If a foreign national received his/her permanent residence status prior to their two year wedding anniversary, then s/he will receive a two year conditional green card.  The foreign national will have a 90 day window to file evidence that the marriage continues to be valid and usually another interview will be scheduled.  If you fail to remove conditions within the allotted time period for doing so, you face the potential of being deported. It is important to have an experienced legal team to guide you through removing conditions on your status. The attorneys at Nassau County Immigration Law Group have over 50 years of combined experience assisting clients with their immigration matters. I-751 Petitions

In order to have conditions removed, an I-751 petition must be submitted with signatures from both spouses. There are waivers to the signature of both spouses, e.g., a divorce or abusive relationship.  Be sure to submit this form within 90 days of the two-year anniversary of your marriage. Failure to meet this deadline can result in deportation unless you are able to convince the USCIS in writing that missing this deadline was through no fault of your own.

Approving an I-751 Petition

Once an I-751 petition has been approved, conditions on your residence will be removed. After this process is completed, you can apply for citizenship if you meet the requirements. The citizenship process can be complicated, but it is rewarding in the end and can allow you to have the same freedoms as your U.S. Citizen spouse, like voting, holding federal positions, and even bringing your family members to the U.S. It is important to have an experienced legal team on your side not only to guide you through the process of removing conditions but also applying for citizenship afterward.
