Recent Changes to DACA

In September of 2017, the DACA program was terminated, which had serious impacts on thousands of individuals who were once protected by this act. However, in January and February 2018, federal courts declared that anyone who was previously protected under DACA will have the opportunity to renew their protected status. It is important to note that with this ruling, it was also determined that the USCIS will no longer accept new requests to be protected by DACA.

Renewing DACA

Even a few years later, the future of DACA is still uncertain and could certainly change again. Anyone who wishes to renew their DACA status will have to do so by filing form I-821D, I-765, the I-765 Worksheet, and pay the fees that accompany these forms. The only people who are permitted to submit a renewal request for DACA are those with a deferred action expiration date that took place on or after September 5, 2017. If your status expired before this date, you cannot submit a renewal request. Additionally, it is important to note that if you have never been granted deferred action, you cannot make a request to receive this protection.

Additional Information Regarding DACA

In most cases, someone who is protected by deferred action has also been approved to work in the United States. Anyone who has a DACA and a work permit that expired after September 5, 2016, will be able to apply for a two-year renewal on both of these permits. It is also important to note that if your deferred action expires after March 5, 2018, your work authorization and your protection will not be subject to this renewal and will expire on the date listed on your approval notice. Be aware that your deferred action and work permit are subject to termination if the government feels that you are no longer eligible. This often happens because the individual committed a crime with a minimum of 90 days of jail time.
